LA Daily Leads - Terms of Service
1. Who we are and who may use the Service
"LA Daily Leads," "we," "us" and "our" refer to the operator of this website and its owners, members, managers, employees, contractors and affiliates. The "Service" means this website, its data, exports, scripts, alerts, integrations and everything else we provide. You may use the Service only if you are at least 18, you are a licensed real estate professional or are working under one, and you have an account we issued. By checking the box at sign-in or by using the Service, you agree to these Terms. If you use the Service for a company, you agree for that company too and confirm you have the authority to do so.
2. What the data is - and isn't
- The Service compiles information from public records (for example court, county, city and published legal notices) and from third-party and publicly available sources, including contact information obtained through lookups. We do not create the underlying records.
- No warranty of accuracy. Records can be incomplete, outdated, mismatched or wrong. A filing does not mean a person is in financial trouble, wants to sell, or still owns the property. Contact details may belong to someone other than the owner even when labeled a match. Labels such as "Verified owner," "Likely owner," "DNC clear" or a lead type are automated, best-effort indicators, not guarantees.
- Not a consumer report. We are not a consumer reporting agency, and the Service is not a "consumer report" under the Fair Credit Reporting Act or California's Investigative Consumer Reporting Agencies Act. You may NOT use any information from the Service to decide anyone's eligibility for credit, insurance, employment, housing or tenancy, or for any other purpose covered by those laws.
- Nothing in the Service is legal, tax, financial or compliance advice. Scripts are examples you must review and adapt; you are responsible for every word you send or say.
3. Your compliance obligations
You are solely responsible for complying with all laws, regulations and rules that apply to your outreach and business, including, without limitation:
- Calls and texts: the Telephone Consumer Protection Act (TCPA) and FCC rules (including consent requirements for autodialed or prerecorded calls and texts to cell phones), the Telemarketing Sales Rule, the National Do Not Call Registry, California telemarketing laws (including Business and Professions Code §17590 et seq. and Civil Code §1770), and any internal do-not-call requests. "DNC clear" flags reflect a check at a point in time against a third-party tool and may be wrong or out of date. You must scrub numbers yourself under your own Subscription Account Number where the law requires it, honor opt-outs immediately, and call only during permitted hours.
- Email: the CAN-SPAM Act and California Business and Professions Code §17529.5, including accurate sender information, a working opt-out and a physical mailing address.
- Distressed and foreclosure situations: California's Mortgage Foreclosure Consultants Act (Civil Code §2945 et seq.), Home Equity Sales Contracts Act (Civil Code §1695 et seq.), and any rules on contacting homeowners in default, probate, bankruptcy or divorce. Do not offer services that require a license or bond you do not hold, do not charge advance fees where prohibited, and do not interfere with a bankruptcy case or court process. Contact with a debtor in bankruptcy must not violate the automatic stay; work through the debtor's attorney or trustee where required.
- Fair housing: the federal Fair Housing Act and California's Fair Employment and Housing Act and Unruh Civil Rights Act. Do not target, exclude or treat anyone differently based on any protected characteristic.
- Privacy: the California Consumer Privacy Act (as amended) and any other privacy law that applies to your own use, storage and sharing of personal information, including honoring deletion and do-not-sell requests you receive.
- Licensing and brokerage rules: California Department of Real Estate regulations, your broker's policies and your MLS or association rules.
Treat every person with courtesy and sensitivity, especially people facing loss, illness, death in the family, divorce or financial hardship.
4. Permitted use and restrictions
- You may use the Service only for your own lawful real estate business.
- You may not sell, resell, license, publish, share, scrape or redistribute the data, exports or scripts to anyone outside your own brokerage team without our written permission.
- You may not share your login. You are responsible for all activity under your account and must tell us right away if you think it has been compromised.
- You may not use the Service to harass, stalk, threaten, defraud or discriminate against anyone, or for any unlawful purpose.
- You may not attempt to break, probe, overload or work around the Service's security.
5. CRM connections, alerts and your keys
If you connect a CRM, webhook or other service, you authorize us to send lead data to it on your behalf and you confirm you are allowed to connect it. You are responsible for the keys you enter, for what happens to data after it reaches your systems, and for any messages your systems send. We may pause or disconnect an integration at any time. Alert emails can be turned off in your settings.
6. Our rights
We may change, suspend or discontinue any part of the Service, add or remove data sources, or suspend or terminate your access at any time, with or without notice, including if we believe you have violated these Terms or the law. The Service, its design, scripts, code and compilation are owned by us or our licensors.
7. Disclaimer of warranties
THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ANY LEAD WILL RESULT IN BUSINESS.
8. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, OR FOR ANY FINES, PENALTIES, STATUTORY DAMAGES OR CLAIMS ARISING FROM YOUR CALLS, TEXTS, EMAILS, MAIL OR OTHER USE OF THE DATA, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM OR ONE HUNDRED DOLLARS ($100).
9. Your indemnity
You will defend, indemnify and hold harmless us and our owners, members, managers, employees, contractors and affiliates from any claims, lawsuits, regulatory actions, fines, penalties, damages, losses and expenses (including reasonable attorneys' fees) arising from or related to: your use of the Service or data; your calls, texts, emails, mail or other contact with anyone; your violation of these Terms or any law (including the TCPA, Do Not Call rules, CAN-SPAM, fair housing and California foreclosure and home-equity laws); your CRM or other connected systems; or anyone using your account.
10. Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute relating to the Service or these Terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Los Angeles County, California, except that either party may bring an individual claim in small claims court or seek an injunction for misuse of the Service or data. You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class, collective or representative proceeding, and you waive any right to a jury trial. Any claim must be brought within one year after it arises.
11. Privacy of your account information
We keep the information you give us (such as your name, alert email, lead preferences, CRM settings and the record of your acceptance of these Terms, including date, time, IP address and browser) to run the Service, secure it and enforce these Terms. Notes and statuses you enter on leads are stored in your own browser unless you send them elsewhere.
12. Changes and general terms
We may update these Terms at any time. You will be asked to agree at each sign-in, and continued use means you accept the current version. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent possible and the rest stays in effect. These Terms are the entire agreement between you and us about the Service. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may. Sections 2, 3, 4, 7, 8, 9, 10 and 12 survive termination.
Questions about these Terms: contact the account administrator who issued your login.
